1. Introduction

Welcome to PostPop ("Company," "we," "our," or "us"). These Terms of Use govern your access to and use of our postcard design and mailing service, including our website and mobile applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

2. Acceptance of Terms

By accessing or using the Service, you represent that you are at least 13 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree to these Terms, you may not use the Service.

3. Service Description

Our Service allows you to:

• Design custom postcards using our application
• Invite friends to receive postcards
• Have postcards mailed on your behalf

4. User Accounts

4.1 Account Creation

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

5. User-Generated Content

5.1 Rights in Content

You retain ownership of all content you create through the Service ("User Content"). By submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, process, reproduce, and transmit your User Content solely for the purpose of providing the Service.

5.2 Content Restrictions

You agree not to submit User Content that:

• Infringes on any third party's intellectual property rights
• Violates any applicable laws or regulations
• Contains harmful, offensive, or inappropriate material
• Includes malicious code or spam

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Interfere with or disrupt the Service's operation
• Use any automated means to access the Service
• Attempt to gain unauthorized access to any portion of the Service
• Impersonate any person or entity

7. Postcard Mailing Services

7.1 Delivery Terms

We will make reasonable efforts to mail postcards as requested. However, we are not responsible for delays or failures in delivery caused by postal services or other factors beyond our control.

7.2 Address Accuracy

You are responsible for ensuring the accuracy of all mailing addresses provided to the Service. We are not responsible for undeliverable mail resulting from incorrect addresses.

7.3 No Liability for Delivery

WE ARE NOT RESPONSIBLE FOR CARD DELIVERY. THIS INCLUDES, WITHOUT LIMITATION:

• Postcards that are lost in transit
• Postcards that arrive late or not at all
• Postcards that are damaged during delivery
• Deliveries affected by strikes, natural disasters, or other disruptions
• Any consequences resulting from non-delivery or late delivery

Once we transfer postcards to the postal service, delivery is entirely at the discretion and responsibility of the postal service provider. No refunds will be provided for undelivered cards.

8. Fees and Payment

Some features of the Service may require payment. You agree to pay all applicable fees and authorize us to charge your selected payment method.

9. Intellectual Property

The Service and its original content (excluding User Content) are and will remain the exclusive property of the Company. Our trademarks and trade dress may not be used without our express written permission.

10. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

12. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service at any time without notice. We may also revise these Terms from time to time. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Deleware / USA, without regard to its conflict of law provisions.
